Terms and Conditions
I. Photobooth Delivery and Set Up
The Portrait (the “Provider”) is responsible for the delivery, setup, breakdown, and maintenance of the photobooth throughout the scheduled rental period. Rental hours are measured as continuous, uninterrupted hours of operation. Any interruptions will be considered as idle time and may incur an additional charge of $100 per hour. The Portrait team will arrive at the earliest possible set up time as discussed, but the photobooth rental will not start until the rental start time.

II. Photobooth Maintenance
The photo booth may run out of paper during the rental period. The Portrait will replenish and restock the photo paper, but this may cause a 5 minute period where the photo booth will have to be shut down. The provider will ensure to its best abilities that this issue does not occur. If this issue does occur, time lost for photobooth maintenance will be added to the end of the rental.

III. Access, Space, and Power for Photo Booth
The Client is responsible for providing a leveled area large enough for the photo booth. This area must be a minimum of 8ftx8ft to ensure that it is able to operate smoothly without blocking foot traffic. This area must be protected from rain, wind, and any weather related situations. The client shall be responsible for providing a 6ft long table to be used for props and accessories. An electrical outlet within 10ft of the booth is required for the functionality of the photobooth.

IV. Date/Venue Changes & Cancellations
Any request for a date change must be made in writing at least thirty (30) days in advance of the original event date at info@theportrait.ca. Change is subject to photo booth rental availability and receipt of a new signed rental contract. If there is no new availability for the alternative date, the current contract shall be canceled and the deposit will be forfeited. Any request for a venue change shall be made in writing at least thirty (30) days prior to the original event date. In no circumstances will the deposit be refunded. The deposit is a non-refundable payment.

V. Photo Frame Templates
All design requests for the photo strip frames must be provided by the client at least 2 weeks prior to the event. If the details are not completed by the deadline, the provider will use The Portrait’s default photo strip template. The Portrait will have the right to use the most recent approved template if a final confirmation is not given by the deadline.
VI. Provider’s Standards Price List
The charges in this contract are based on the Provider’s Photobooth Price List. The price list may be adjusted periodically and future orders shall be charged based on the prices in effect at the time of booking.

VII. Deposit and Balance Payment
Local sales tax applies to the total of the rental. A 50% non-refundable deposit is required to reserve the date requested for the photobooth rental. If the deposit is not received within 1 week of signing the contract, the booking may not be guaranteed. Bookings are on a first come, first serve basis. In no circumstances will the deposit be refunded. The deposit is a non-refundable payment.
The remaining balance is required to be paid 14 days before the event. If additional hours are added on the day of the event, payment is required immediately. The deposit is subject to a refund if notified within 7 days of the initial booking. Any remaining balance shall be refundable if notified at least 30 days prior to the scheduled event. The credit card used for the deposit will be kept on file for 1 day after the event. The client will be informed if responsible for any damages occurred at the event.
VIII. Media Usage
The client agrees to allow The Portrait to use any video recordings, event images, or photos captured by the machine for advertising purposes (ex. Instagram, TikTok, Company Website).
IX. Damage to Provider’s Equipment & Refusal
The Client acknowledges that they are responsible if there are any damages or loss to the equipment caused by: a) Any misuse of the Provider’s equipment by its guests (invited or uninvited) or b) Any theft that occurs during the rental. The Client acknowledges that The Portrait has the right to decline service to its guests (invited or uninvited), for misuse, or unruly behavior

X. Indemnification
Client agrees to, and understands the following: a) Client will indemnify Provider against any and all liability related to Client’s event during or after the event. Client will indemnify the provider from the time or services and on into the future, against any liability associated with Client and guests. b) Client will indemnify Provider against any and all liability associated with the use of pictures taken within the photobooth of it’s representatives, employees, and/or guests at the Client’s event.
